THE FOUR BEDROOM PRIVATE BEACH RESIDENCE
From the private, gated entrance of each of the six 4 Bedroom Beach Residences a colonnaded walkway leads across a courtyard garden into the massive living room that looks out to the beach and ocean. Beyond an open-plan kitchen are the dining terrace, swimming pool and sun deck. Also on the ground floor is an ensuite guest bedroom and a guest bathroom with indoor and outdoor showers. A grand staircase leads to the second level of this L-shaped residence. Here, fanning out from a central study are an open-sided lounge, an enormous master suite and two more guest bedroom suites.
LAND LEASE AND PURCHASE AGREEMENT
Residence ownership is structured upon a sublease basis and lasts for the duration of the lease of Resort between Management Company and the Maldivian Government. Any future lease extensions will be passed on to the buyer at a formula equal to [(1/total number of villas) x lease extension price for the island]. At Resort the remainder of the Government lease currently stands at 42 years (as of 2020). Resort has an option to extend the lease for an additional 49 years – the this will be finalised between the government and the owners of Resort and Residences. All owners are provided with a strata title’ deed which provides evidence of sublease ownership according to the laws of the Maldives.
Your Residence is yours to enjoy. Our Residence Rental Programme has been carefully created to be tailored to your lifestyle needs. The Residential Rental Programme is a compulsory part of our sublease ownership terms. It allows you to enjoy your Private Residence and offset the ownership expenses with an income generated by the rental of your property when you are not at the resort. Every quarter, Property will calculate the gross revenues generated by your Residence. In order to ensure the smooth running of the Rental Programme, well ask you to provide us with a schedule of when you would like your Residence to be made available for your exclusive use over the next calendar year. Gross revenues will exclude sales commission and gross taxes. From gross revenues, Resort will take 10% to pay for those expenses associated with the rental of your residence, such as utilities, housekeeping, laundry, daily room amenities for villa guests and marketing expenses.
The remaining 90% of room revenue is split between you and Resort on a 50/50 basis. From your 50% share, annual ownership expenses equivalent to 1.5%^ of the purchase price are deducted. A further 0.5% of the purchase price will be deducted annually and set aside. The resulting net revenues can then be remitted to you (subject to applicable Maldivian withholding and income taxes, currently at 15%). You can also keep the net revenue inresort and apply it against future spending. This way, you can use it as credit against additional holiday expenses incurred from using resort facilities and amenities such as your food and drinks, excursions, water- sports and spa treatments.
WHAT ARE THE OWNERSHIP REGULATIONS? Ownership of a Residence is transferred pursuant to Tourist Resorts (Transfer of Rights) Rules No: 2010/R-14 published in the Maldivian 2010. On handover of the Residence, an application will be lodged with Ministry of Tourism to obtain a strata title5 which will be a Government Gazette on 9 December dive evidence of ownership of the property. IS RESIDENCE OWNERSHIP LEASEHOLD OR FREEHOLD? Ownership is leasehold. Villa ownership is offered on a sublease basis between Resort and our Residence owners, for the duration of the lease of the island between Resort and the Maldivian Government. Any future lease extensions will be passed on to the buyer at a formula equal to [(1/total number of villas) x lease extension price for the island]. HOW IS OWNERSHIP STRUCTURED? Ownership is structured via a series of onshore and offshore legal agreements. These agreements comprise, but are not limited to, a Reservation Agreement, a Lease Agreement evidencing the buyers5 lease rights and a Management Agreement (showing developers exclusive right to manage the property on behalf of the buyer), as well as a Rental Agreement which shows the terms of rental of the property (optional for Residences yet to be constructed). WHICH TAXES DO I PAY? Owners are primarily liable to two taxes, (i) Tourism Goods and Service Tax @12% payable on the gross invoice value at time of purchase; and (ii) Annual Business Profit Tax @15% on the net profit from rental revenues. WHAT DOES MALDIVES VILLA OWNERSHIP INSURANCE COVER? Ownership insurance offers owners the peace of mind of having comprehensive insurance coverage to protects them against damage to the Residences. The insurance cover includes building cover, personal accident, plant and machinery, electronics, natural perils and fire. More information can be provided upon request.
